1. Acceptance of Terms

By downloading, installing, or using SteadiDay™, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the app.

You must be at least 13 years old to use this app. SteadiDay™ is designed for adults 50 and older.

2. Description of Service

SteadiDay™ is a wellness and safety app for adults 50+ that helps you:

• Track medications and receive reminders, with optional label scanning via your camera
• Manage daily tasks, appointments, and calendar events
• Monitor health and wellness metrics via Apple Health (iOS) or Health Connect (Android)
• Track food and water intake
• Manage medical information including doctors, insurance cards, and medical records
• Reach emergency contacts quickly with Emergency SOS
• Use fall detection with Safety Sessions for live location sharing with emergency contacts
• Share daily activity summaries with a caregiver
• Use helpful tools like magnifier, flashlight, notes, parking spot saver, and timer
• Enjoy brain games (word scramble, memory match, trivia, and more) and balance exercises
• Check local weather conditions

3. Medical Disclaimer

• The app is designed for general wellness and organizational purposes only
• Always consult with qualified healthcare professionals for medical advice
• Do not disregard professional medical advice based on information from this app
• Medication reminders are convenience tools, not replacements for professional care
• The Emergency SOS feature is a convenience tool that contacts your trusted contacts — it does not replace calling 911 or your local emergency services
• The Emergency SOS and fall detection features use SMS text messaging to alert your trusted contacts. Message delivery depends on carrier networks and is not guaranteed. Message and data rates may apply.
• AI-powered features (such as medication label scanning and insurance card scanning) use automated text recognition and may produce inaccurate results — always verify extracted information before relying on it
• Health data displayed from Apple Health or Health Connect is for informational purposes only and has not been verified by SteadiDay for accuracy

If you have a medical emergency, call 911 or your local emergency services immediately.

4. User Responsibilities

You are responsible for:

• Maintaining accurate medication, health, and contact information in the app
• Keeping your device and app PIN secure
• Using the app in compliance with applicable laws
• Ensuring your medication schedules and health information are current
• Backing up your device regularly (SteadiDay™ data is included in your iPhone backup). You can also sign in for automatic secure backup.

You agree not to misuse, reverse engineer, decompile, or attempt to access the app's source code.

5. Subscription Terms

SteadiDay™ is free to download with core features available at no cost. Optional premium subscriptions are available to unlock additional features.

5.1 Free Features

The following core features are always free:

• Emergency SOS and trusted contacts
• Fall detection and Safety Sessions
• Basic medication tracking and reminders
• Basic task management
• Health data viewing
• Food and water tracking
• Utility tools (magnifier, flashlight, notes, parking, timer)

5.2 Premium Subscriptions

Premium subscriptions are available in Monthly, Annual, and Lifetime tiers. Premium features may include health screenings, calendar sync, cloud backup, custom themes and sounds, task templates, and additional emergency contacts. New users may be eligible for a free trial period.

• Subscriptions are billed through the Apple App Store or Google Play Store
• Payment is charged to your App Store or Google Play account at confirmation of purchase
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• You can manage or cancel your subscription at any time through your device's App Store or Google Play Store settings
• No refunds are provided for partial subscription periods, though refund requests may be submitted to Apple or Google per their policies

5.3 Changes to Pricing

We may adjust subscription pricing or features from time to time. We will provide advance notice before any pricing changes take effect. Core safety features (Emergency SOS, Trusted Contacts, Fall Detection) will remain free.

6. Intellectual Property

SteadiDay™ and its content are protected by copyright and trademark laws.

• The app design, code, and content are owned by SCM Solutions LLC
• You may not copy, modify, or distribute any part of the app
• User-generated content (your data) remains your property
• We use your data only to provide app functionality on your device

7. Limitation of Liability

To the maximum extent permitted by law:

• The app is provided "as is" without warranties of any kind, either express or implied
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app
• We are not responsible for missed medication reminders, health outcomes, or data loss
• Our total liability is limited to the amount you paid for the app in the 12 months preceding the claim

This limitation applies to all claims, including negligence.

8. Termination

You may stop using SteadiDay™ at any time by uninstalling the app. Upon uninstallation, all your data stored in the app is removed from your device. If you have an account, you can delete it and all associated server data from within the app settings before uninstalling. If you have an active subscription, uninstalling the app does not cancel your subscription — you must cancel through the App Store or Google Play Store.

We may update, modify, or discontinue any part of the app at any time. If we discontinue the app entirely, we will provide reasonable notice when possible.

9. Changes to Terms

We may modify these terms from time to time. We will update the "Last Updated" date at the top of this page. Continued use of the app after changes constitutes acceptance of the updated terms. If you disagree with any changes, you may stop using the app.

10. Governing Law

These terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to conflict of law provisions.

Any disputes will be resolved through binding arbitration in Virginia, except where prohibited by law. If any provision of these terms is found unenforceable, the remaining provisions remain in full effect.

11. AI-Powered Features

SteadiDay™ uses artificial intelligence (AI) services provided by OpenAI to power certain features:

• Medication Label Scanning: Uses AI vision technology to read text from photos of prescription labels
• Insurance Card Scanning: Uses AI vision technology to read text from photos of insurance cards
• Voice Transcription: Uses AI to convert speech to text for voice input features

You acknowledge that:

• AI-powered text extraction may produce errors — always review and verify the information before relying on it
• SteadiDay does not save source photos or audio in its application database; OpenAI may retain API inputs and outputs for up to 30 days for service delivery and abuse prevention unless shorter retention controls apply
• These features require an internet connection to function
• We are not responsible for inaccuracies in AI-generated text extraction or transcription
• You should not rely solely on AI-extracted information for medical decisions

12. SMS Text Messaging Terms

12.1 Emergency SMS Program

SteadiDay™ includes an SMS text messaging feature as part of its Emergency SOS and fall detection functionality. When you enable these features and add trusted contacts, you authorize SteadiDay™ to send SMS text messages to your designated trusted contacts on your behalf during emergency events.

12.7 Safety Sessions & Live Location Sharing

SteadiDay™ includes optional Safety Sessions that allow you to share your real-time location with designated emergency contacts through a secure, tokenized link. Location sharing begins only when you start a Safety Session. The server stores the most recent coordinates needed to operate the live link; ended sessions are automatically deleted after approximately 24 hours, and abandoned sessions expire automatically. You can end a Safety Session at any time to stop further updates and close the link. For full details, see our Privacy Policy.

12.2 Consent

By adding one or more trusted contacts within the SteadiDay™ app and enabling the fall detection or Emergency SOS features, you expressly consent to the following:

• SteadiDay™ may send automated SMS text messages to your trusted contacts when fall detection activates and you do not respond within the countdown period.
• SteadiDay™ may send automated SMS text messages to your trusted contacts when you manually trigger the Emergency SOS feature.
• These messages will include your display name, your GPS location, and an alert message requesting your trusted contacts check on you or call emergency services.

This consent is not required to use other features of the app.

12.3 Message Frequency and Rates

Message frequency varies. SMS messages are sent only during emergency events. Message and data rates may apply based on your mobile carrier plan. SteadiDay™ does not charge any fees for SMS messages.

12.4 Opt-Out and Withdrawal of Consent

You may withdraw your consent to emergency SMS messaging at any time by:

• Removing your trusted contacts from the app
• Disabling the fall detection feature in app settings
• Uninstalling the app

Trusted contacts who receive emergency alert messages may reply STOP to opt out of future messages. For assistance, reply HELP or email support@steadiday.com.

12.5 SMS Data Privacy

Mobile phone numbers provided for the SMS program will not be shared with or sold to third parties or affiliates for marketing or promotional purposes. For complete details on how SMS data is handled, see our Privacy Policy.

12.6 SMS Disclaimer

The SMS emergency alert feature is a convenience tool provided as-is. SteadiDay™ does not guarantee message delivery, as SMS delivery depends on carrier networks, device signal strength, and other factors outside our control. This feature does not replace calling 911 or your local emergency services. If you have a medical emergency, call 911 immediately.
